Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("User", "you") and Shiven Infotech ("we", "us", "Company") governing your use of the Shiven Vastu mobile and web application ("the App").

By creating an account or using the App, you accept these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to create an account. By signing up, you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.

2. Your account

  • You are responsible for keeping your login credentials secret.
  • Notify us immediately at support@shivenvaastu.com if you suspect unauthorised use.
  • One person — one account. Sharing accounts is not allowed.
  • We may suspend or terminate accounts that violate these Terms.

3. The Service

Shiven Vastu provides:

  • AI-assisted floor-plan generation from sketches, descriptions, or photos.
  • Classical Vastu Shastra analysis (rule-based score + AI commentary).
  • Vastu predictions, remedies, defect detection, and site recommendations.
  • PDF report generation.
  • Booking and consultation with Vastu experts ("Subscribers").
  • In-app wallet (powered by Razorpay) for paid services.

We may add, change, or remove features at any time. We will give reasonable notice for material changes that affect paid features.

4. Vastu disclaimer — important

All Vastu analyses, predictions, remedies, site recommendations, defect reports, and AI chatbot responses provided by the App are advisory and based on a combination of classical Vastu Shastra rules and AI interpretation.

They are NOT:

  • a substitute for consultation with a qualified human Vastu consultant;
  • a substitute for the advice of a licensed structural engineer or architect;
  • a guarantee of any life outcome (health, wealth, career, relationships, business growth, etc.).

You agree that any decision you take based on the App's output — including structural changes to your property, financial decisions, or lifestyle changes — is your sole responsibility. We disclaim all liability for outcomes arising from such decisions, to the maximum extent permitted by law.

5. Content & ownership

5.1 Your content

You retain ownership of the floor plans, sketches, descriptions, photos, predictions, and text you upload or create in the App. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, display, and back up your content solely for the purpose of providing the Service to you. We do not use your content to train any AI model.

5.2 Our content

The App, including its source code, UI, brand, AI prompts, blueprint renderer, Vastu rule engine, and report templates, is owned by Shiven Infotech and protected by Indian and international copyright and trademark laws. You may not copy, redistribute, decompile, or reverse-engineer any part of it.

5.3 Acceptable use

You must not:

  • Upload illegal, defamatory, obscene, or copyright-infringing content.
  • Use the App to harass another user or Subscriber.
  • Probe, scan, or test the security of our infrastructure.
  • Circumvent rate limits or scrape data programmatically.
  • Use the App for any purpose other than personal or business Vastu analysis.

6. Payments, wallet & refunds

  • All paid features are charged in INR through Razorpay.
  • Successful wallet top-ups are non-refundable except where required by law.
  • Expert bookings can be cancelled per the cancellation policy on the expert's profile. Refunds, where due, are credited back within 7–10 business days.
  • Disputes about charges must be raised within 30 days at support@shivenvaastu.com.

7. Subscribers (experts)

  • You confirm you are qualified to offer the services you list.
  • You are an independent contractor — not our employee, agent, or partner.
  • We deduct a platform fee from your earnings per your Subscriber agreement.
  • You are responsible for any taxes (GST, income tax) on your earnings.

8. Privacy

Our handling of your personal data is governed by our Privacy Policy. By accepting these Terms you confirm you have read and understood the Privacy Policy.

9. Service availability

We aim for 99% uptime but do not guarantee uninterrupted availability. We may pause the Service for maintenance, security upgrades, or events outside our control.

10. Limitation of liability

  • Our total liability for any claim is capped at the greater of (a) INR 1,000 or (b) the amount you paid to us in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, or business interruption.

11. Termination

You can delete your account at any time from /delete-account or from Profile → Delete account in the app. We may terminate or suspend your account immediately on material breach of these Terms.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Navi Mumbai, Maharashtra, India.

13. Changes to these Terms

We may amend these Terms. Material changes will be announced in-app at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance.
